General Terms and Conditions (GTC)

1. Scope

These conditions apply to all agreements between Starupphoto – Charlotte Starup (hereinafter “Photographer”) and her clients.

2. Services

The Photographer offers portrait, family, boudoir, and business photography. The exact scope of services results from the booked package or an individual offer.

3. Prices & Payment

The prices agreed upon at the time of booking apply.

The Session Fee must be paid no later than the day of booking.

The images must be paid for on the day of ordering and photographing, unless otherwise agreed in writing.

The Session Fee does not include any images.

4. Appointments & Cancellation

• A booking is binding.

• If the client cancels less than 7 days before the photo session, the Session Fee is forfeited.

• If the Photographer must cancel due to illness or force majeure, a replacement appointment will be offered. Further claims are excluded.

5. Right of Withdrawal & Returns

Since all services and products of the Photographer are individually created and personalized, there is no right of withdrawal in accordance with § 312g Abs. 2 Nr. 1 BGB.
All sales are final and excluded from exchanges or returns.

6. Usage Rights

The client receives a simple, non-transferable usage right for the purchased images for private use (e.g., social media, prints).
Commercial use or transfer to third parties is only permitted with the Photographer’s written consent.

7. Liability

The Photographer is liable only for intent and gross negligence. She assumes no liability for technical failures, force majeure, or data loss on the client’s side

8. Applicable Law & Place of Jurisdiction

German law applies. Place of jurisdiction is Starnberg.
